Terms of Use

The short version

• These are the rules for using our website and apps. They apply to everyone, including people just browsing.
• Browsing is free and doesn't need an account.
• You may not scrape the directory. No bots, no bulk copying, no harvesting teacher details. This is the one rule we enforce hard, and clause 7 explains why.
• Listings and reviews are written by users, not by us. We don't independently verify most of what's in them.
• If you want to book a lesson, take payments, or subscribe, the Terms of Service govern that. It's the substantive agreement.
• Your Australian Consumer Law rights are untouched by anything here.

1. About these terms

These Terms of Use (Terms) govern your access to and use of:

• teachmusic.com.au and its subdomains;
• our mobile applications;
• the embeddable badge and widget we offer teachers for their own websites; and
• any other site or app we operate that links to these Terms

(together, the Site).

The Site is operated by Eric Kuang trading as Sounds of Music (ABN 84 785 256 878) of 18 Caroline Crescent, Blackburn North VIC 3130 (TeachMusic, we, us, our).

By accessing the Site you accept these Terms. If you don't accept them, please don't use it.

1.1 How these fit with our other documents

If these Terms conflict with the Terms of Service, the Terms of Service prevail for the subject matter they cover: bookings, payments, subscriptions, verification, liability and disputes.

2. Changes

We may update these Terms. The version and date at the top tell you what you're reading.

For material changes (anything reducing your rights or adding obligations) we'll give at least 30 days' notice by a prominent notice on the Site and, if you have an account, by email. Continuing to use the Site after the effective date means you accept the change. Account holders who don't accept a material change can close their account; teachers on a paid plan have the additional rights in clause 30 of the Terms of Service.

3. Who may use the Site

Anyone may browse. You don't need an account to search for teachers, view profiles, or read reviews.

You must be at least 18 to create an account. Children never hold accounts in their own name: a student under 18 is always attached to a parent or guardian's family account. See clause 3 of the Terms of Service.

The Site is intended for use in Australia. We built it for Australian teachers and Australian families, under Australian law. You may access it from elsewhere, but we don't represent that it's appropriate or lawful to do so, and you're responsible for complying with your own local laws.

4. Your account

Choose a strong, unique password and keep it to yourself. You're responsible for what happens under your account, unless it results from our failure to keep the Site secure.

One account per person. Don't share it, sell it, or let someone else use it.

Tell us immediately at support@teachmusic.com.au if you think someone else has got into your account.

We may suspend or close an account that breaches these Terms. See clause 15.

5. Availability

We aim to keep the Site up, but we don't guarantee it will always be available, uninterrupted, or error-free. We may change, suspend, or withdraw any part of it, and we may restrict access to registered users. We'll give notice of planned downtime where we reasonably can.

You're responsible for your own setup: your device, your internet connection, and your own security software.

6. What you may do

You may:

• browse, search and read the Site for your own personal, non-commercial purposes;
• contact teachers through our enquiry and messaging features, to genuinely enquire about lessons;
• create an account and use the features your account gives you;
• print or save individual pages for your own reference: for example, a shortlist of teachers you're considering;
• link to the Site from your own site, fairly and lawfully, in a way that doesn't suggest we endorse you; and
• if you're a listed teacher, embed our badge or widget on your own website, unmodified, with the link intact.

7. No scraping, crawling, or bulk extraction

This gets its own clause because it's the rule people most often break, and the one we take most seriously.

You must not, and must not permit anyone else to:

• use any robot, spider, scraper, crawler, script, or automated means to access, monitor, index or copy any part of the Site, except a search engine crawler obeying our robots.txt;
• extract, harvest, collect or compile teacher names, contact details, listing content, pricing, availability, reviews, photographs, or location data: whether by automated means, by hand, or by paying someone else to;
• copy, republish or redistribute a material portion of the directory, or use it to build, train, populate or supplement another database, directory, mailing list or dataset;
• use the Site's content to train a machine learning or AI model, or to generate a derived dataset, without our written permission;
• frame, mirror, or deep-link the Site so as to present our content as someone else's;
• circumvent, disable or interfere with rate limiting, access controls, robots.txt, or any technical measure protecting the Site; or
• misuse the enquiry system: sending enquiries that aren't genuine lesson enquiries, to harvest contact details, to market to teachers, or to recruit them to another platform.

Why we care. The directory exists because thousands of teachers spent time building a profile, and because we verify checks one at a time, by hand. A scraper takes all of that in an afternoon and gives nothing back. It also exposes teachers (many of whom teach children from their homes) to exactly the kind of bulk contact-harvesting they trusted us to prevent.

What we'll do about it. We monitor for automated access. We may block IP addresses, suspend accounts, and take legal action, including for breach of these Terms, breach of copyright in the compilation, and where applicable under the Criminal Code Act 1995 (Cth) for unauthorised access to a computer system.

If you want the data, ask. We ship a public REST API and webhooks, and teachers can export their own studio data in full, any time, for free. There are legitimate routes for almost anything you might genuinely need: support@teachmusic.com.au.

8. What you must not do

Beyond clause 7, you must not:

Break the law or hurt people

• use the Site for any unlawful purpose, or to facilitate one;
• post or transmit anything that is defamatory, abusive, threatening, harassing, obscene, hateful, or discriminatory;
• post anything that endangers, exploits, or is harmful to a child, or that sexualises a minor in any way;
• stalk, harass, or impersonate any person.

Deceive

• impersonate anyone, or misrepresent your identity, qualifications, affiliation, or Working With Children Check status;
• create an account under a false name, or create accounts to manipulate reviews, ratings, or response statistics;
• post a review you're not entitled to post (see clause 11 of the Terms of Service).

Attack the Site

• introduce a virus, trojan, worm, or any other malicious code;
• attempt to gain unauthorised access to the Site, its servers, or any database;
• launch a denial-of-service attack, or place unreasonable load on our infrastructure;
• probe, scan, or test the vulnerability of the Site without our prior written permission (see clause 9);
• reverse engineer, decompile, or disassemble any part of the Site, except to the extent the Copyright Act 1968 (Cth) says we can't stop you.

Misuse it commercially

• use the Site for commercial purposes other than as a listed teacher using the features you've subscribed to;
• resell, sublicense, or make the Site available to a third party as a service;
• advertise or solicit on the Site, or use it to promote a competing directory or software product;
• send spam, chain messages, or bulk unsolicited communications.

9. Responsible security disclosure

If you find a security vulnerability, please tell us. We'd much rather hear from you than from an attacker.

Email security@teachmusic.com.au with enough detail to reproduce it. Please give us reasonable time to fix it before disclosing it publicly, and don't access, modify, or delete anyone else's data while investigating.

We won't pursue legal action against a researcher who acts in good faith, follows this clause, and doesn't exfiltrate personal information. That's a commitment, not a courtesy.

10. Content on the Site

10.1 Content written by users

Teacher profiles, reviews, and messages are written by users, not by us.

• Listing information (biographies, qualifications, pricing, availability, photographs) is provided by the teacher.
• Reviews are written by families who booked or enquired through the Platform.

We do not independently verify most of it. The exception is Working With Children Checks, which we verify by hand against government registers, and even then, clause 5 of the Terms of Service sets out exactly what that verification does and does not mean. Read it before you rely on a badge.

Opinions expressed in reviews are the reviewer's, not ours.

We may remove content that breaches these Terms, but we don't pre-screen everything and we don't undertake to. If something on the Site is inaccurate, offensive, or unlawful, please tell us at support@teachmusic.com.au. See clause 12.

10.2 Content written by us

Guides, price information, location pages and editorial content are provided for general information only. They aren't professional, financial, legal, or educational advice. We try to keep them accurate and current, but we don't warrant that they are.

Indicative pricing (like a suburb's median hourly rate) is derived from real listings on the Platform at a point in time. It's a guide, not a quote. Confirm the actual price with the teacher.

11. Your content

You keep ownership of everything you post: your listing, your photos, your reviews, your messages.

You grant us a licence to host, store, reproduce, adapt (for formatting and display), publish, and distribute your content in connection with operating and promoting the Platform. It's non-exclusive, royalty-free, and worldwide, because the internet is. It lasts as long as your content is on the Site, and ends when you remove it: apart from copies in our backups, copies cached by search engines, and material already included in printed or distributed marketing.

You warrant that:

• you own your content, or have the rights to post it;
• it doesn't infringe anyone's copyright, trade mark, privacy, or other rights;
• everyone appearing in a photograph or video has consented, and where that's a child, their parent or guardian has consented in writing; and
• it's accurate and not misleading.

We may remove your content if it breaches these Terms. Except where there's an immediate safety or legal concern, we'll tell you and give you a chance to fix it.

12. Reporting content

If something on the Site is inaccurate, infringes your rights, or breaches these Terms, tell us at support@teachmusic.com.au. Include the page, what the problem is, and how to contact you.

Copyright complaints go to legal@teachmusic.com.au with: what work you say was copied, where it appears on our Site, proof you own it or act for the owner, your contact details, and a statement that you believe in good faith the use isn't authorised.

Child safety concerns go to safety@teachmusic.com.au, and if a child is in immediate danger, call 000 first.

13. Our intellectual property

The Site, the TeachMusic name and logo, our software, our design system, our editorial content, and the compilation and arrangement of the directory are owned by us or licensed to us, and protected by Australian and international law.

The directory as a compilation is our property, even though individual listings belong to the teachers who wrote them. That's the point of clause 7.

You get a limited, revocable, non-transferable, non-exclusive licence to use the Site as set out in clause 6. Nothing else transfers. Don't use our name or logo without written permission, except that a listed teacher may use the badge or widget we provide, unmodified.

14. Links to and from other sites

Links out. Teacher profiles may link to a teacher's own website. Our editorial content may link elsewhere. We don't control those sites and don't endorse them. Once you leave the Site, our Terms and our Privacy Policy stop applying: read theirs.

Tracked outbound links. Clicks on a teacher's website link route through our redirect, which logs the click and appends tracking parameters, so we can show that teacher how much traffic we sent them. See Privacy Policy section 3.1.

Links in. You may link to our home page or any public page, fairly and lawfully, without suggesting association or endorsement we haven't given. Don't frame our pages inside your own, and don't link from a site that isn't yours or that contains unlawful content. We can ask you to remove a link, and you must.

15. Suspension and termination

We may suspend or terminate your access if you breach these Terms.

We'll give you notice and a chance to fix it: except where there's a credible child-safety concern, apparent fraud, active scraping or attack, a legal requirement, or an immediate risk to someone, in which case we'll act first and explain afterwards.

You can appeal to support@teachmusic.com.au and a person will review it.

If you hold a paid subscription, the more detailed process in clause 20 of the Terms of Service applies, including your data export rights, which survive termination.

You can stop using the Site any time, and close your account from your settings.

16. Accessibility

We aim to meet WCAG 2.2 Level AA, and we treat accessibility as a release requirement rather than a later polish item: visible focus states, 4.5:1 text contrast, keyboard operability, and support for reduced-motion preferences.

We won't always get it right. If you hit a barrier, please tell us at support@teachmusic.com.au and we'll fix it and help you get what you needed in the meantime.

17. Disclaimers

Read clause 25 of the Terms of Service first: your Australian Consumer Law rights override everything in this clause.

Subject to those rights, and to the extent the law permits:

• the Site is provided "as is" and "as available";
• we don't warrant that it will be uninterrupted, secure, error-free, or free of viruses;
• we don't warrant that content on the Site is accurate, complete, or current: particularly content written by users;
• we don't warrant that any teacher will respond to you, be available, be suitable, or deliver a lesson to any standard; and
• we're not responsible for the conduct of any user, on or off the Site.

We are not the music teacher. Clause 4 of the Terms of Service explains our role, and it's worth understanding before you rely on anything here.

18. Liability

Our liability to you is governed by clauses 25 and 26 of the Terms of Service, which apply to your use of the Site as if set out here in full.

In short: nothing limits your Australian Consumer Law rights, or our liability for death or personal injury caused by our negligence, or for fraud. Beyond that, our liability is capped and indirect losses are excluded, to the extent the law allows.

19. General

Severability. If a clause is unenforceable, it's read down or severed and the rest stands.

Waiver. Not enforcing something once doesn't mean giving it up.

Assignment. You can't transfer your rights under these Terms. We can transfer ours to a related company or a buyer of the business, on notice.

Entire agreement. These Terms, the Terms of Service and the Privacy Policy are the whole agreement about your use of the Site.

Governing law. These Terms are governed by the laws of Victoria, Australia, and we each submit to the non-exclusive jurisdiction of its courts. If you're a consumer, this doesn't take away your right to bring proceedings in your home state or territory, or to use a tribunal there.

Disputes. Clause 28 of the Terms of Service applies: talk to us first, and we'll try to sort it out.
